In Queensland there is a long established body of law that ensures both employers and employees are treated fairly by one another - this is known as employment law or labour law.

There are several circumstances that may give rise to an employment dispute, including:
  • an employee being fired in an unacceptable way
  • an employee being fired without good reason
  • issues associated with retrenchment of employees
  • workplace health & safety issues
  • industrial action
  • arguments about an employment contract
  • an employee not being paid in accordance with his or her contract or a relevant award
Of course not all employment disputes frame the employer as the bad guy and the employee as the innocent victim - there are many scenarios where an employer may wish to exercise his or her legal rights to ensure an employee meets his or her obligations.

In many cases an employment dispute can be resolved without involving the court system, which usually take the form of lawyers for both party pointing out their client's legal position and negotiating accordingly - with the aim of a) ensuring justice prevails and b) keeping the matter outside of the court system. There are times when these negotiations fail, and usually the first port of call is not a court but another body set up by the Commonwealth Government to attempt to find a resolution prior to court action being instigated.
